Lemon Law- Do you need a Lawyer?
The answer is a definite "maybe". It all depends on which State you live in. (Actually where you bought it or where you registered it.)
In some States all you need is proper documentation. Then you simply file a Complaint (fill out a form). In other States, you will need to hire a lawyer to do it for you.
If you need a Lawyer, Who Pays?
Some States, (about half) allow you to recover Attorney Fees (if you win).
If your State allows your lawyer to sue under the Magnuson-Moss Warranty Act, you can be awarded Attorney Fees.
In these cases, Attorney's Fees are based on actual time spent not on a percentage of the recovery, like in liability cases.
Warning: In some States, if you lose you must pay not only your own Lawyer Fees but also the manufacturer's Lawyer Fees too.
The good news is that most Lawyers will give you a free initial consultation to determine if you have a Lemon Law case or not. If he determines that you have a case, you can discuss fees at that point.
Each state has slightly different Lemon Laws so use the list at the right to check the State Statutes for your particular State.
